What should I do if I'm hurt on the job?

Seek immediate medical treatment.
Tell your employer. You are required to give written notice within 30 days.
Continue receiving treatment as necessary through a health care provider registered with the New York State Workers' Compensation Board.
File a claim with the Workers' Compensation Board. All claims must be filed within two years.

It is your responsibility to participate actively in your care, attend all appointments and/or hearings and return to work as soon as medically possible.

What is workers' compensation?

Workers' compensation is insurance that provides medical care and benefits for wages lost for workers who are injured or become ill as a direct result of their job.

Claims are processed through the New York State Workers' Compensation Board and paid according to the law. The Workers' Compensation Board is a state agency that oversees how employers and insurers handle the claims of injured workers.

Am I eligible for workers' compensation?

Almost all New York State employers must provide workers' compensation coverage for employees. If you suffer an illness or injury as a direct result of your job, then you are likely eligible. You may apply regardless of your immigration status.

How do I file a claim?

There are two ways to file an employee claim (C-3):

Online: Visit www.wcb.ny.gov to fill out an online claim.

Paper: Visit a NYS Workers' Compensation Board customer service center, print the form from the website, or call (866) 396-8314 to have a form mailed to you.

Is my claim information protected?

All documents submitted to the Workers' Compensation Board about your case are private and only the appropriate parties to your claim may receive information. Besides you, your representative or attorney and your health care provider, this includes:

Your employer
Your employer's workers' compensation insurance carrier and its representative
Any party you or the court authorize to access information

How does the Workers' Compensation Board process work at Bassett?

Make an appointment and tell the scheduler it is for a workers' compensation visit. Only discuss concerns related to your workers' compensation injury at your visit.

On the day of your visit:

Inform registration that you have arrived for a workers' compensation visit, provide the date of injury, your employer's full name, address, and phone number and any other necessary insurance information.
Notify the staff during pre-examination AND your health care provider that this is a workers' compensation visit.
Tell your provider the reason for your visit, including the specific injury and part of your body affected under this workers' compensation claim.
Remember to only discuss problems directly related to your workers' compensation injury. Discussion and/or treatment related to other medical conditions during your visit may result in a bill that will be your responsibility to pay.

If you and your provider believe there may be an additional problem as a result of your original work-related injury, then you need to:

Make sure the provider notes this in your file as well as how it is related to the claim.
Contact the Workers' Compensation Board and request a hearing to add this new issue to your established claim.

Before scheduling any non-emergent tests, check to see if your workers' compensation insurance carrier requires you to use a specific diagnostic testing network.
